Watkins Inc., a smaller company, alleges that McCormick decreased the amount of pepper in their tins by 25% without changing the tin’s size. This means that although the tins appear unchanged, they actually contain less pepper.

Watkins claims that McCormick is deceiving consumers by making them believe they are getting more pepper in each tin than they actually are. McCormick’s tins are opaque, so it’s difficult to see how much pepper is inside. On the other hand, Watkins sells smaller tins that contain the same amount of pepper as McCormick’s.
Watkins argues that McCormick is attempting to mislead consumers to make their product appear superior to others. They contend that McCormick relies on deceptive packaging rather than improving their product. Although McCormick’s tins are labeled as containing 6 ounces of pepper, the text is small and not immediately noticeable.
This tactic, known as “slack-filling,” is considered dishonest and violates consumer protection regulations. By not filling their tins completely, McCormick is not providing customers with as much pepper as they might expect. This not only affects the value for money but also makes it difficult to accurately compare products.
